Texas does offer spousal support under 10 years for a period of up to 3 years after the marriage for women who are considered disabled. My wife has fibromyalgia. Although she uses it as an excuse not to work, the main reason I'm not fighting her on it is
a) I want this resolved as quick as possible and without lawyers
b) I have personal businesses and right now she is not trying to get 50% of them like she could if it went to court so the spousal support for the next 3 years is my way of making sure that doesn't happen
c) she only has a GED and has limited income earning potential... and I do care about my daughter so the spousal support payments will help sure my daughter doesn't have to live like a poor person -- by the time the spousal support payments are gone, so will the child support and my daughter will be an adult so at that point I will be able to walk away knowing I did what I could (at least financially) to get them both on their feet
d) even tho my wife can be a hella bitch, she is not the one who wants the divorce.. I'm the one leaving her after 8 years. I don't feel guilty as far as my reasons, but there is a certain amount of guilt over just the situation that she is being put in.
e) I have the ability to make more with my businesses... and once the support payments are set and she can't get any more of my businesses because she's already passed up the chance on her ownership, I just need to focus on making a lot more money and then the support payments are irrelevant from a financial perspective :) And down the line it'll drive her nuts when she finds out I started making a lot more money AFTER we got divorced haha
If she does decide to fight it with a laywer, I'll definitely be fighting her on the spousal support and her ability to work. 90% of the time she's actually a reasonable and nice person... it's the 10% of the time she's a total fucking bitch that is the problem. Her family are a big part of a problem her parents are total assholes... she wouldn't have even consulted a lawyer if not for them pushing her to. Of course the lawyer came up with a totally high and unrealistic figure (duhhh -- he wants you to hire him)
