Near DUI

A bunch of guys went out to finn last night. My one and only lifelong enemy is going to be there so my "state" or whatever is fucked up. I just get to drinking. I don't know how many drinks i had but i was HAMMERED. I ended up with 2 girls numbers in my phone and i don't even really remember them, but that's all i can say for the PUA-ing. Which sucks because the quality was money last night.

The drive home I was really bombed. I'm on Belt Line and i notice a cop creeping up behind me, i'm doing like 10 mph and it looks like he's about to pull me over. So I pull in to the Kobe Steaks parking lot and just chill there. 15 minutes later the cop comes back and tells me to step out of the vehicle. He's like "why are you here?"

ME: "well sir I realized I'm not in any condition to drive so I immediately pulled in to this here fine parking center and called a friend to come pick me up. I'm waiting." (bullshit btw)

OFFICER: "why is your car running?"

ME: "well sir, it's a pretty hot night and i sure do like the air conditioner."

OFFICER: "let me see your phone"

blah blah blah and somehow I manage to smooth talk my way out of any kind of ticket or arrest. ;)


However, now my car is sitting there. AND MY KEYS ARE FUCKING MISSING!!! Car keys, apartment keys, a VPN key for my laptop, mailbox key, everything!

FUCK!

Given my line of work, I have a lot of experience with DWI's. I'll tell you right now, you got damned lucky on this one.

Yeah that was super lucky...wow what a nice cop.

He could have certainly given you a public intoxication ticket I think.

So given the situation what is the smart thing to do there? Should he have taken his keys out of the ignition and thrown them on the floor to avoid any possibility of a ticket?

Very lucky.

What's ironic is that my "enemy" that i told you about got in the same situation a few days ago, where he pulled over, and he got a DWI! Apparently it's illegal to be drunk in your car even if you're not actually driving anywhere. Had I known that I probably wouldn't have pulled in.

To add to my luck I even found my keys. My friend who came and gave me a ride home had put them in her purse for safekeeping.

It's illegal to (1) operate (2) a motor vehicle (3) in a public place (4) while intoxicated.

if the same cop who was creeping behind you earlier was the one who talked to you in the parking, and he determined you were intoxicated, he could have arrested you b/c he saw you driving earlier (assuming he can prove it was the same car)

if the cop who saw you driving would have called you in and a different cop pulled in the parking lot to question you and determined you were intoxicated, you could still be arrested for DWI b/c the other cop could prove that you were driving.

if some cop sees you parked in a parking lot with the ignition running and never actually sees you driving the car - very unlikely that you could be arrested for DWI. But, PayerCool is right - you could be possibly arrested for public intox if the cop determines you are a "danger to yourself and other due to being intoxicated"

That's basically what the law says. For any more detail, you're going to have to ask me in person. Still, you're one lucky bastard!

I know a dude that drank too much in a bar and crawled into the backseat of his car and went to sleep. A cop later woke him up banging on his car and arrested him. I thought that was a crappy thing to do since the guy was trying to do the right thing.
