Not a Good Patent Application

I think [link=http://appft1.uspto.gov/netacgi/nph-Parser?Sect1=PTO1&Sect2=HITOFF&d=PG01&p=1&u=%2Fnetahtml%2FPTO%2Fsrchnum.html&r=1&f=G&l=50&s1=%2220080040131%22.PGNR.&OS=DN/20080040131&RS=DN/20080040131]this patent application[/link] has a statutory bar due to prior disclosure and public use. Does it seem familiar to anybody else?

Somebody should tell this Erik von Markovik guy (his identity is a real mystery) that he's wasting his money.

Notice how Mystery is in Vegas...but had to use a patent lawyer all the way in Scottsdale, AZ. Must be difficult to get someone to push it through...

This could be a defensive strategy. He might have filed it to get "patent pending" status. Then he can put all of the other pickup gurus on notice so they stop teaching the M3 model. A lot of companies do this and just keep it pending as long as they can so they can keep saying "patent pending." I hope he realizes that he will never get a patent on this, not an enforceable one anyway.
